Property consent orders: What you get for $2,500 + GST

WE TAKE CARE OF EVERYTHING INCLUDING:
  • Initial consultation with a family lawyer
  • Drafting of Application for Consent Orders and Proposed Orders Sought
  • Review call to discuss the draft
  • Sending documents to the other party for signature
  • Filing all documents with the Court
  • Managing the Court portal and keeping you updated
  • Responding to Court queries or requests
  • Final orders delivered to both parties once sealed
ADD ONS (OPTIONAL):
  • Superannuation Split: + $400 (includes required fund notification and service of order)
WHATS NOT INCLUDED IN THE FIXED FEE:
  • The standard Court filing fee, which is currently $205

Divorce application: What you get for $990 + GST

WE TAKE CARE OF THE COURT PROCESS INCLUDING:
  • Initial consultation with a family lawyer
  • Drafting Application for Divorce
  • Sending documents to the other party for signature (if required)
  • Filing all documents with the Court
  • Managing the Court portal and keeping you updated
  • Responding to Court queries
  • Arranging for a process server to serve documents on the other party (if required)
  • Final orders delivered to both parties once sealed
WHATS NOT INCLUDED IN THE FIXED FEE:
  • The standard Court filing fee, which is currently $1,125 (or reduced if eligible for concession)
  • Fees to third parties, such as translators or process servers (if required)

Representing you at a Mediation

Mediation is a process used to help parties reach agreements about parenting arrangements and/or property division without going to court.

Mediations are usually held “shuttle style” where you and the other party are in separate rooms (or virtual breakout rooms) and a trained, independent mediator facilitates discussions by “shuttling” back and forth between the rooms sharing proposals, clarifying concerns and helping you both work toward an agreement.

Each party can have their own lawyer present during the mediation to provide legal advice, explain rights and obligations, help negotiate fair outcomes and to draft the terms of the agreement reached.

Sharing in a mediation is usually a faster, less stressful, and more affordable option than going through the court system, and any agreements you reach can be made legally binding.

Binding Financial Agreements

Before you can enter into a legally binding financial agreement the law says that each person must receive independent legal advice from a lawyer and have a signed Certificate of Independent Legal Advice. Without this step, it is likely that the agreement will not be legally enforceable.

WE CAN PROVIDE YOU WITH ADVICE INCLUDING:
  • Reviewing the agreement
  • Advising you on the contents (both verbally and in writing)
  • Making changes to the agreement
  • Certificate of Independent Legal Advice

Only cases with no significant complications or disputes are eligible for the fixed fee – but never fear we can still assist you with your legal issues.

Who is eligible for divorce?

Is there a time limit on property settlement?

Yes – 12 months after divorce or 2 years after de facto separation.
