WHAT’S INCLUDED IN THE FIXED FEE:
  • 30-minute consultation with a legal practitioner
  • Drafting the Application for Divorce and other relevant documents
  • Filing the Court Documents in the Federal Circuit and Family Court of Australia
  • Arranging for a process server to serve the documents on the other party (if required)
  • Guidance throughout the process
WHAT IS NOT INCLUDED IN THE FIXED FEE:
  • The standard Court filing fee, which is currently $1,125 (or reduced if eligible for concession)
  • Any process server fees (if required)

Do I have to go to court?

Only in certain circumstances. For example, if you request to attend, if there are children and the other party objects to the divorce, or if there are issues that need addressing such as insufficient evidence of “separation under one roof.”

Court appearances for Divorce applications generally occur by phone.

What if we still live under one roof?

You can apply, but need to provide a statement providing the details of your living arrangements after separation.

Can I remarry after my divorce?

Yes, you can remarry after the divorce is final. That is usually one month and one day after the hearing.
